The recent judgment of Hermens v Hermens (December 2017) outlines the importance of ensuring applications for divorce are accurately and truthfully completed. Failing to do so may result in the application being dismissed in its entirety or applications being returned for correction. This ultimately leads to delays in processing your application.
The judgment reinforced that:
‘A divorce petition is a document which has the effect of changing the status of individuals permanently if it leads in due course to a decree of divorce and it is, as a matter of public policy, essential that the particulars in that document are true. That is why the Court requires the filing of affidavits attesting to the truth of what is in the petition.’
